A woman who was given a traffic ticket for wearing Google Glass while driving has pleaded not guilty in court, according to The Guardian.

Cecelia Abadie, 44, said she was wearing the device but it was not on while she was driving. She was pulled over by an officer on the San Diego freeway back on Oct. 29 for speeding.

The officer didn't just give her a speeding ticket however, he also penalized her for distracted driving.

"I was wearing it because I do wear it all day, but I was not using it," Abadie said to San Diego TV station 10news. "A lot of people don't understand how the device works, and the fact that you're wearing it even if the device is turned on doesn't mean that you're watching it or using it actively."

On Dec. 3, William Concidine, her lawyer, denied the charges, saying there is no law against wearing the device while driving if it isn't turned on.

"Our primary argument is that Ms. Abadie was not driving while Google Glass was actually operational", Concidine said in a statement, according to The Guardian. "The issue will be what does the officer who cited Ms. Abadie testify to at the trial regarding whether he saw, or did not see, the Google Glass being used while Ms. Abadie was driving the vehicle."

Drivers are not allowed to drive with a TV, video screen, or any similar "means" of displaying a TV broadcast or video signal while operating a vehicle, according to the California Vehicle Code.

Google has not commented regarding the incident specifically but did say earlier this year that Google Glass Explorers should "put their safety and the safety of others first."

"It's early days for Glass and we look forward to hearing feedback from Explorers and others in advance of a wider consumer launch next year," said a Google spokesman in October.

The speeding ticket given to Abadie reads that she was going 80 mph in a 65 mph zone.
