Jaqueline Badger Mars, an owner of candy company Mars Inc., will face a reckless driving misdemeanor charge for her part in a fatal crash.
The 74-year-old has a net worth of $23.2 billion, making her the 27th richest person in the world, according to Bloomberg Businessweek.
Mars will appear in court on Dec. 5. She was served on Oct. 29 with a summons.
The heiress was reportedly driving a Porsche SUV in Aldie on Oct. 4 when it crossed over the center line and hit a minivan.
The sheriff's office said an 86-year-old minivan passenger Irene Ellisor of Huntsville, Texas was killed at the scene, according to CBS News.
Most of Mars' fortune comes from owning one-third of Mars Inc., the second-largest candy marker in the world.
Mars' company owns other brands like Milky Way, Snickers, and M&M's.
"As court proceedings begin, Jacquie's thoughts and prayers remain with those who have suffered injury and loss," Kent Jarrell, Mars's personal spokesman, said in a statement. "She regrets this tragic accident."
