Actress Amanda Bynes' drunken driving case will be referred to a mental-health court, a judge decided this week.
Bynes did not appear in court on Sept. 24, but her lawyer did, arguing that Bynes was not capable of understanding the proceedings, according to TMZ.
"The mental health court will examine Bynes and determine her competency to stand trial," attorney Richard Hutton said to E! News.
Bynes was arrested back in April 2012 on suspicion of SUI in West Hollywood after she supposedly clipped the rear corner of a sheriff's deputy's cruiser while trying to go around it at 3 a.m.
The arrest is just one of Bynes' many vehicle-related issues the past couple of years.
The former "All That" star's odd behavior hit an all-time low in July when she was put on involuntary psychiatric hold after lighting a small fire in the driveway of a house.
She was put on 72-hour hold at first, which was extended to two weeks, and then 30 days. Her stay could be increased by up to a year when all is said and done according to TMZ.
Bynes' mother has a temporary conservatorship over her with "regard to the 27-year-old's well-being and personal finances" according to the Los Angeles Times.
He next scheduled court date in the DUI case has been set for Jan. 7.
